Ballot to endorse employee request: make a complaint
Make a complaint under Regulation 8(7), 8(8) or 10(2) of the Information and Consultation of Employees Regulations 2004.

Details
If a request for information and consultation arrangements is made by fewer than 40% of employees, and there is a pre-existing agreement, the employer can hold a ballot to determine whether employees endorse the request. There are 3 complaints that can be made about the ballot:
- Has the employee informed the employees, within 1 month of the request, that it intends to hold a ballot?
- If the employer has informed the employees that it intends to hold a ballot, has the ballot been arranged or has it taken place prematurely?

If the ballot has taken place, did it comply with the Regulations which state:
- the ballot must be fair
- all employees must be entitled to vote
- voting is in secret
- votes are accurately counted
