Details

If a request for information and consultation arrangements is made by fewer than 40% of employees, and there is a pre-existing agreement, the employer can hold a ballot to determine whether employees endorse the request. There are 3 complaints that can be made about the ballot:

  • Has the employee informed the employees, within 1 month of the request, that it intends to hold a ballot?
  • If the employer has informed the employees that it intends to hold a ballot, has the ballot been arranged or has it taken place prematurely?
  • If the ballot has taken place, did it comply with the Regulations which state:

    • the ballot must be fair
    • all employees must be entitled to vote
    • voting is in secret
    • votes are accurately counted
