PRELIMINARY ISSUE 鈥� Applicant prohibited from performing any function in relation to regulated activities because it appeared to the Authority that he was not a fit and proper person 鈥� Applicant had been found guilty of conduct unbefitting a solicitor by the Solicitors Disciplinary Tribunal who ordered that he be struck off the Roll of Solicitors 鈥� whether the findings of that Tribunal could be relied upon by the Authority in this reference without the need to re-prove each and every allegation 鈥� yes 鈥� preliminary issue determined in favour of the Authority 鈥� Financial Services and Markets Act 2000 s 56.
