SPM167600 - Statutory Neonatal Care Pay (SNCP) - general information: Notice and Evidence Requirements
The notice that an employee must provide depends on whether they are taking a tier 1 or tier 2 absence. See SPM150200 for definitions of tier 1 and tier 2.
For tier 1 absencesan employee must provide notice within 28 days starting with the first day of the week they want to claim for.
For a single statutory pay week beginning in the Tier 2 period, notice must be given no later than 15 days before the first day of the statutory pay week to which the notice relates.
The notice must be made in writing for each period that is claimed and must include
- their name
- the date of the child’s birth
- the date the child started to receive neonatal care (and the end date if it has ended)
The employee will also need to provide the employer with a declaration, to confirm:
- that the employee has cared or intends to care for the child during the period applied for, and
- they meet one of the conditions as to the relationship with the child or baby (see SPM 150300). They only need to provide this once when they first ask for pay so if they take two separate weeks, they only need to provide the declaration for the first week taken within the timeframe detailed above.
