This memorandum addresses issues arising under the European Convention on Human Rights (鈥淓CHR鈥�) in relation to the Data Retention and Investigatory Powers Act. The Department is satisfied that, in the event that the Bill is introduced into parliament, the responsible minister could make a statement under section 19(1)(a) of the Human Rights Act 1998 that, in his or her view, the provisions of the Bill are compatible with the Convention rights.
