How to stop a grant of probate by post

Who can apply

You can apply to stop a probate application (also known as 鈥榚nter a caveat鈥�) if, for example, you have a dispute about:

  • who can apply for probate
  • whether a will exists

You can apply if you鈥檙e aged 18 and over and:

  • an executor named in a will
  • an interested party
  • a probate practitioner (such as a solicitor)

Fee

It costs 拢3 to stop an application for 6 months.

How to apply

You can apply online to stop a probate application.

If you鈥檙e an executor named in a will or an interested party, you can also apply by post.

If you鈥檙e a probate practitioner, you can also apply by post or email.

You can apply to stop the probate application before or after the application is received.

If successful, you鈥檒l get a 鈥榗aveat鈥� 鈥� a stop to the grant of probate from being issued, which lasts for 6 months.

Apply by post

  1. Download the form.

  2. Fill in all the sections.

  3. Print the form.

  4. Sign and date the form.

  5. Pay the 拢3 application fee by sending a cheque payable to 鈥楬M Courts and Tribunals Service鈥� with your form.

  6. Send the completed form to:

Apply by email as a probate practitioner

  1. Download the form.
  2. Fill in all the sections.
  3. Sign and date the form.
  4. Pay the 拢3 application fee using Payment by Account.
