Pub-Owning Businesses' Compliance Reports 2023-24
Transparency data
As part of our ongoing commitment to ensuring transparency and fairness in the tied pub sector, the Pubs Code Adjudicator (PCA) has released an overview of key aspects of the latest annual Compliance Reports submitted by regulated pub-owning businesses (POBs). We have also released an infographic on the total number of pubs code agreements and size of the regulated estate.

Marston鈥檚 agreed to pay 100% of an arbitrator鈥檚 fees and costs in a Pubs Code arbitration after failing to identify the relevant costs provisions in their submissions to the arbitrator.

The 6 regulated pub-owning businesses have worked together with the PCA to agree minimum standards in dealing with tied tenants on short agreements over and above what the Pubs Code requires.

The PCA is concerned to ensure that pubs companies are fully compliant with regulation 46 of the Pubs Code relating to premises insurance, and in particular, a tied tenant鈥檚 right to price match.

This information is from the PCA on upcoming changes to the website.

If you have a query about the Pubs Code or an arbitration referral, you may find the answer in our helpful factsheets: /government/collections/pubs-code-factsheets.
Alternatively, complete our enquiry form, or send us an email. If you would prefer to discuss your enquiry, you can request a call back by telephoning the number above.
Please note: the PCA cannot deal with complaints about pubs. This includes concerns about pub staff or service.
Referrals
Pubs Code arbitrations are managed by the Chartered Institute of Arbitrators (CIArb) on behalf of the PCA. Full details, including how to pay the referral fee, can be found on their website:
There is a difference between a general enquiry and a formal referral to the PCA for arbitration. You can only make a referral if you are a tied tenant (or a pub owning business in relation to market rent only disputes), or authorised to act on their behalf.
