This Instrument repeals and revokes domestic legislation concerning the Unified Patent Court (UPC) and the European Patent with Unitary Effect (Unitary Patent or UP). This legislation would have implemented the UPC and UP system but is no longer necessary following the withdrawal of the United Kingdom (UK) and Isle of Man (IoM) from the Agreement on a Unified Patent Court on 20 July 2020. The implementing legislation was due to take effect upon commencement of the UPC and UP system in the UK. However, this will now not occur. This instrument provides clarity by removing pending legislation relating to a system that the UK and IoM will not participate in. The UK and IoM patent system will continue to operate unchanged after the instrument passes.

This instrument is required to help ensure that the UK has a functioning statute book at the end of the Transition Period. Under section 3 of the European Union (Withdrawal) Act 2018 (鈥渢he Withdrawal Act 2018鈥�), directly effective EU legislation will be retained in UK law at the end of the Transition Period. This instrument makes amendments to the retained version of Regulation 2019/1150 of the European Parliament and of the Council of 20 June 2019 on promoting fairness and transparency for business users of online intermediation services (鈥渢he Online Intermediation Services Regulation鈥�) to ensure that it functions correctly in domestic law at the end of the Transition Period.

The purpose of this instrument is to amend the International Accounting Standards and European Public Limited-Liability Company (Amendment etc.) (EU Exit) Regulations 2019 (SI 2019/685) (鈥淚AS SI鈥�). The IAS SI addressed failures of retained EU law to operate effectively and other deficiencies arising from the withdrawal of the UK from the EU, in the field of accounts and reports of UK corporate bodies. This instrument provides a transitional arrangement for companies whose financial years 鈥榮traddle鈥� the Implementation Period completion day (鈥淚P completion day鈥�), for the purposes of the IAS SI. The instrument also makes minor amendments to correct errors in the IAS SI and ensures that the Statutory Auditors and Third Country Auditors (Amendment) (EU Exit) Regulations 2019 (SI 2019/177) (鈥淎udit SI鈥�) functions as intended. The instrument will apply to companies and other undertakings, but companies are referred to throughout for ease of reference.

This instrument intends to address deficiencies in the operation of retained European Union (鈥淓U鈥�) law arising from the UK鈥檚 withdrawal from the EU and the European Atomic Energy Community (鈥淓uratom鈥�). This instrument revokes redundant provisions deriving from four EU instruments related to the Euratom Research and Training Programme and the associated Fusion for Energy (F4E) Joint Undertaking which have become retained EU law under the European Union (Withdrawal) Act 2018 (鈥渢he Act鈥�).

This instrument amends statutory instrument, Electricity Network Codes and Guidelines (System Operation and Connection) (Amendment etc.) (EU Exit) Regulations 2019 (S.I. 2019/533) and will help ensure that legislation governing the UK鈥檚 energy systems will function effectively in the event that the UK leaves the European Union (鈥楨U鈥�) without a withdrawal agreement in place on 31 October 2019. It ensures that three Commission Regulations for electricity connection codes become retained EU law. These codes did not apply in full before an exit date of 29 March 2019 but they will now apply in full before exit as a result of the Article 50 extension to 31 October 2019.
