De-registration of National Community Homes CIC (formerly known as Larch Housing Association Ltd): Court of Appeal decision

Our statement on the Court of Appeal's decision to refuse National Community Homes CIC鈥檚 application to further appeal against its deregistration.

We welcome the Court of Appeal鈥檚 on 17 February 2023 to refuse National Community Homes CIC鈥檚 application to further appeal against its deregistration.

This followed a by the High Court in December 2022 to dismiss National Community Homes CIC鈥檚 appeal against deregistration. The provider then applied to the Court of Appeal to challenge the High Court鈥檚 decision, but permission to further appeal was refused.

National Community Homes CIC had persistently breached the regulator鈥檚 Governance and Financial Viability Standard, and failed to demonstrate its ongoing viability. The provider could not demonstrate that it met the relevant registration criteria and, following the High Court鈥檚 judgement in December 2022, RSH removed it from the register of providers of social housing.

Jonathan Walters, Deputy Chief Executive of聽RSH, said:

We welcome the Court of Appeal鈥檚 decision. All social landlords need to comply with our registration requirements and, when they persistently fail to do so, we will take appropriate action 鈥� including de-registration when it鈥檚 needed.
