Consultation description

The Master of the Rolls has asked the Civil Procedure Rule Committee (CPRC) to review the Pre-Action Protocols (PAP).

The amendments will reflect the recommendations in the final report of Lord Justice Jackson reviewing litigation costs () and will clearly set out the consequences of non-compliance with the protocols.

The CPRC is taking the opportunity to update references and links, remove out of date sections and to include common sections such as a stocktake stage where appropriate in all the Pre-Action Protocols.

A subcommittee of the CPRC has prepared the draft of a new protocol, the Pre-Action Protocol for Debt Claims. This Protocol contains much of the information contained in the existing Pre-Action Protocol for Conduct which, once amended, will serve as the Pre-Action Protocol where no other suitable protocol is available.

The CPRC now invites written responses on the detail of the Pre-Action Protocol for Debt.
