Detail of outcome

The CMA has now published its response to the consultation and its guidance for businesses, their advisors and other stakeholders on the CMA鈥檚 substantive and procedural approach to assessing competition in digital markets under the Digital Markets, Competition and Consumers (DMCC) Act 2024. The CMA has also published relevant guidance for the聽reporting of a merger by firms designated by the CMA as having Strategic Market Status (SMS), under the DMCC Act 2024. The guidance received approval from the Secretary of State for Business and Trade on 17 December 2024.

Under the DMCC Act the CMA must obtain the approval of the SoS before publishing the guidance. The SoS must approve the guidance or give reasons to the CMA for not approving it before the end of the 30th working day after the day on which the CMA seeks the SoS鈥檚 approval. The Competition and Markets Authority (CMA) . The guidance will be published following approval.
