Detail of outcome
This is the analysis by the Department of Health and Social Care (DHSC) of responses to their consultation to amend the Health and Social Act 2008 (Regulated Activities) Regulations 2014 (the 鈥2014 regulations鈥).
Respondents supported the amendment to remove the 2014 regulations鈥 expiry date of 31 March 2025 and instead review the regulations every 5 years.
The government鈥檚 next step is to introduce a statutory instrument in January 2025 for this amendment. This means it will become law, subject to Parliamentary debate in early 2025.
Responses were broadly supportive of the policy intention of the proposals relating to:
- treatment (not first aid) in a sports ground or gymnasium
- temporary arrangements to deliver medical care (not first aid) at sporting or cultural events
- introducing a new requirement to notify CQC of the use of restraint, segregation and seclusion in mental health units
From the analysis of consultation responses, the department concluded that these proposals need more policy and operational consideration before being introduced through amendments to legislation.
