You may be able to claim compensation if you have pneumoconiosis caused by coal mining.

Claim for other conditions and diseases

All other compensation schemes are now closed. You may still be able to claim Industrial Injuries Disablement Benefit (IIDB) or make a claim through the courts.

Get to make a claim through the courts for:

• noise induced hearing loss (NIHL)
• respiratory conditions such as chronic obstructive pulmonary disease (COPD)
• hand arm vibration related conditions such as vibration white finger (VWF)
• other asbestos related conditions such as mesothelioma

You may be able to get compensation for diffuse mesothelioma if you don’t know the employer responsible for your contact with asbestos, or their insurer.

You may be able to claim under the Coal Industry Pneumoconiosis Compensation Scheme (CIPCS) if you have pneumoconiosis caused by coal mining. The CIPCS is also known as the Coal Workers� Pneumoconiosis Scheme (CWPS).

Who can claim

To claim through the scheme you must be getting Industrial Injuries Disablement Benefit (IIDB) for one of the following health conditions:

• pneumoconiosis, including ‘black lungâ€�, asbestosis and silicosis
• diffuse bilateral pleural thickening
• lung cancer (primary carcinoma) with diffuse bilateral pleural thickening
• lung cancer (primary carcinoma) with asbestosis

You must also have worked for 10 years or more in coal mining. Some of your employment must have been as an employee or a contractor in a mine that was licensed by either:

• the National Coal Board (NCB)
• the British Coal Corporation (BCC)

Claiming for a miner who has died

You may be able to claim if you’re the husband, wife or family member of a deceased coal miner.

The person who died must have been eligible to claim and at least one of the following must apply:

• they were getting IIDB for one of the eligible health conditions
• one of the eligible health conditions was listed as a cause of death on their death certificate

If they died in the last 12 months and weren’t getting IIDB when they died, contact your local Jobcentre Plus. You might still be able to claim.
