Judicial Summary

Appeal by male teaching assistant against Disclosure and Barring Service (DBS) decision to place him on children鈥檚 barred list following six findings of what the DBS described as 鈥済rooming type behaviour鈥� in 3 different girls鈥� schools over a period of 9 months. The Upper Tribunal found that the DBS鈥檚 findings that 5 of the 6 allegations were made out did not involve any material mistake of fact. Overall, the fact that one of the allegations was not made out was not material to the decision to include the appellant on the children鈥檚 barred list.
