Judicial Summary

There is no right of appeal to the Upper Tribunal against a Traffic Commissioner鈥檚 decision, taken under section 16(4) of the Goods Vehicles (Licensing of Operators) Act 1995, to refuse to accept an operator鈥檚 request to terminate (surrender) its licence. However, the Upper Tribunal expressed the obiter view that the lawfulness of such decisions might legitimately arise for determination on an appeal against a Commissioner鈥檚 decision, taken after refusing a surrender request, to revoke an operator鈥檚 licence.
