Judicial Summary

The appellant was the holder of a restricted licence who had been convicted of various offences including assault by beating following an altercation with another driver. He had also committed breaches of the drivers鈥� hours and tachographs rules. The Traffic Commissioner concluded that he did not satisfy the requirement of fitness, revoked the licence and disqualified the appellant for a year. The Upper Tribunal considered the applicability of Redsky in such circumstances and concluded that the decision was not plainly wrong.
