Judicial Summary

(1) Where a Traffic Commissioner鈥檚 refusal to grant a 鈥榩eriod of grace鈥� is integral to the Commissioner鈥檚 decision to revoke an operator鈥檚 licence, the Commissioner鈥檚 reasons must provide some explanation as to why a period of grace was refused. (2) The OTC鈥檚 misleadingly restrictive description of the purpose of a public inquiry, given when informing an operator, in a Proposal to Revoke letter, of its right to request an inquiry, rendered the Traffic Commissioner鈥檚 subsequent decision to revoke the operator鈥檚 licence procedurally unfair.
