Judicial Summary
(1) Where a Traffic Commissioner鈥檚 refusal to grant a 鈥榩eriod of grace鈥� is integral to the Commissioner鈥檚 decision to revoke an operator鈥檚 licence, the Commissioner鈥檚 reasons must provide some explanation as to why a period of grace was refused. (2) The Office of the Traffic Commissioner鈥檚 (OTC) misleadingly restrictive description of the purpose of a public inquiry, given when informing an operator, in a Proposal to Revoke letter / notice under section 27(2) of the Goods Vehicles (Licensing of Operators) Act 1995, of its right to request an inquiry, rendered the Traffic Commissioner鈥檚 subsequent decision to revoke the operator鈥檚 licence procedurally unfair.
