Judicial Summary
Where an operator had made a valid request for a period of grace it was procedurally unfair for the Traffic Commissioner not to deal with that request. It was also procedurally unfair to fail to follow up the operator鈥檚 lack of response to an email from the Office of the Traffic Commissioner (OTC), in circumstances where the OTC (a) had sent the operator other correspondence by recorded delivery and (b) knew there was an outstanding request for a period of grace that it had not dealt with.
